Export Law

This award is for the paralegal working in their particular department in Legal Practice, Commerce, Industry or the Public Sector department doing work of a specialised or semi-specialised nature. The Fellowship Award means that a paralegal can further add to their specialist knowledge in that particular area of law and/or practice in which they are involved.

The Law of Contract (General Principles): Defined; Types; Formation; Terms; Misrepresentation; Mistake; Discharge; Remedies for breach.

Conflict of Law: Defined; Resolution; The Contracts (Applicable Law) Act 1990; Common Law Rules; The Jurisdiction of the Courts; Enforcement of Foreign Judgments.

International Sale of Goods (General Principles): Defined; The Sale of Goods Act 1979; The Uniform Laws on International Sales Act 1967; United Nations Convention; Incoterms 1990.

The Law of Agency: Defined; Types; Agent's Authority; The doctrine of the Undisclosed Principle; Duties; Termination of Agency.

Competition Law: Defined; Monopolies and Restrictive Trade Practices; European Union; Article 85 of the Treaty of Rome; Exemptions thereto; Article 86; Regulation 17.

Payments for and Finance of Exports: Problems; Negotiability; Negotiable Instruments; Bills of Exchange; Collection procedures; Letters of Credit; Non-recourse finance; Factoring.

Export Insurance: Nature and principles of insurance; Marine insurance; Duty to disclose; contracts of insurance; types; Cargo clauses and policies; Warranties; The Insurance Policy; The Marine Insurance Act 1906; General average.

International Carriage: Defined; the common carrier; common law aspects; international carriage; legal relationships; documentation; Bills of lading; carrier's liability; jurisdiction; statutory limitations.

Arbitration: Defined; procedures; statutory regulation; non-domestic arbitrations.

Method of Study

This is a distance learning course. As a distance learning student, you study at home in your own time. Access to a law library or law texts is essential as the award involves research. There are no time constraints.

Assessment

The Fellowship Award is assessed through three substantial 'work based' assignments / projects of some 5000 words each. There are no time limits involved.

Cost

The cost of the Award is £350 or deposit of £150 and four monthly payments of £50.

Delivery Policy: Upon receipt of the course fees, or if paying by installments on receipt of the initial payment, the course material is delivered by first
class post or emailed within twenty-one days. Refund / Return / Cancellation Policy: A student can cancel within 10 days of the receipt by them of the
study material supplied and will receive a refund of the full amount paid, less the sum of £25 to cover administration costs, provided that the said study
